Twish Cart™ Wish Cart Policy


Effective Date: November 10, 2025

1. Description of the Wish Cart Service

The Wish Cart Service allows groups of users to collaboratively create and submit a collective grocery or product order proposal through the Twish Cart™ platform.
 Each Wish Cart may include:

  • A list of preferred products, quantities, and brands.

  • The full names and contact information of all participating members.

  • Individual and collective budgets.

  • Delivery address or pick-up location.

  • Any relevant dietary restrictions, preferences, or product substitutions.

Twish Cart™ will use this information to source, consolidate, and fulfill the order collectively on behalf of the group.

2. Eligibility

To use the Wish Cart Service, each participant must:

  • Be at least 18 years of age (or the age of majority in their jurisdiction).

  • Have a registered Twish Cart account in good standing.

  • Provide accurate, complete, and verifiable personal and payment information.

  • Consent to the collective sharing of personal data within the Wish Cart group for order processing purposes.

Twish Cart™ reserves the right to refuse participation or cancel any Wish Cart that violates our policies, involves fraudulent activity, or contains incomplete or false information.

3. Creation and Submission of a Wish Cart

A Wish Cart may be initiated by a Lead Member (the “Organizer”), who is responsible for:

  • Compiling and submitting the group order proposal via the Twish Cart™ platform.

  • Adding participant details, budgets, and product preferences.

  • Confirming the final list of items and delivery arrangements before submission.

Each participant will receive a digital confirmation and must approve their individual contribution and share of payment before the order is finalized.

4. Pricing and Payment Terms

  1. Prices displayed are collective bulk rates and may vary depending on suppliers, quantities, and availability.

  2. All participants agree that Twish Cart will process payment collectively or individually based on the group’s arrangement.

  3. Once the order is confirmed, payments are non-refundable, except in cases of product unavailability or verified service error.

  4. Any price adjustments, substitutions, or partial order fulfillments will be communicated to the Organizer for approval.

Twish Cart™ reserves the right to modify prices or cancel any Wish Cart prior to payment processing if significant pricing or supply errors are identified.

5. Delivery and Pick-Up

  1. Wish Cart orders may be delivered collectively to a designated Group Delivery Address or made available for individual pickup at selected partner hubs.

  2. Delivery times are estimates and subject to supplier and courier availability.

  3. Twish Cart™ is not liable for delays due to weather, supplier issues, or circumstances beyond reasonable control.

  4. All participants must ensure safe and timely collection of goods upon delivery or pickup notification.

6. Dietary Preferences and Restrictions

Users may indicate specific dietary preferences or restrictions (e.g., vegan, gluten-free, halal).
 While Twish Cart™ endeavors to source compliant products, we cannot guarantee that all products are free from allergens, cross-contamination, or meet all specified dietary standards.
 Users are advised to verify all product labels and ingredients upon receipt.

7. Group Responsibilities and Conduct

All participants in a Wish Cart agree to:

  • Communicate respectfully and transparently with group members.

  • Avoid misuse of group funds, personal data, or product allocations.

  • Resolve internal disputes amicably before contacting Twish Cart™ support.

The Organizer bears primary responsibility for ensuring group compliance and authorizing order confirmation.

8. Cancellations and Modifications

  • A Wish Cart can be modified or cancelled by the Organizer before payment confirmation only.

  • Once processed, the order is final and subject to the standard return and refund policy.

  • Twish Cart™ may cancel a Wish Cart at any time due to:

    • Payment failure,

    • Product unavailability,

    • Fraudulent activity, or

    • Violation of this Policy.

In such cases, users will receive prompt notice and a full or partial refund as applicable.

9. Privacy and Data Protection

All participant data (names, addresses, budgets, and preferences) are collected and processed in compliance with Twish Cart™’s Privacy Policy and Canadian Personal Information Protection and Electronic Documents Act (PIPEDA).
 By participating in a Wish Cart, you consent to the controlled sharing of your data within the group for the purpose of order coordination and delivery.

10. Liability and Disclaimer

Twish Cart™ acts solely as a facilitator of collective purchasing and does not assume liability for:

  • Disputes between participants;

  • Errors in participant-provided information;

  • Supplier delays or substitutions beyond Twish Cart™’s control;

  • Health or dietary risks related to food or product consumption.

In no event shall Twish Cart™’s liability exceed the total amount paid by the affected participant for their portion of the Wish Cart.

11. Termination and Suspension

Twish Cart™ reserves the right to suspend or terminate any user account or Wish Cart that violates this Policy or poses a risk to other users or the platform.

12. Governing Law

This Policy shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.
 Any disputes shall be resolved in the courts located in Ottawa, Ontario, Canada.

13. Acceptance of Terms

By creating or joining a Wish Cart, you acknowledge that you have read, understood, and agreed to be bound by these terms and conditions.
